LAS VEGAS, Nev. (FOX5) – A judge dismissed the lawsuit against F1 from businesses who have claimed the race made them suffer financial losses.
According to the lawsuit, Gary Ellis Enterprises is listed along with two other parties who claim the 2023 F1 event caused $50,000 in damages and were seeking payment for their losses.

Judge Joanna Kishner heard the arguments of all parties and ultimately decided the court would side with F1 and dismissed the case for failure to state a clear claim. Judge Kishner also moved to give Ellis Island and their attorney a chance to make changes to their argument.
The attorney representing Ellis Island said, “We were treading unknown waters here,”
“So here is where the court is going to go,” Kishner responded. “I will grant a motion to dismiss with leave to amend, that gives you the opportunity to determine whether or not you can plead it as a separate cause of action,”
Before Judge Kishner ended the hearing, she requested a calculation of the damages if they look to bring the case back to court.
