LAS VEGAS, Nev. (FOX5) -The American Civil Liberties Union of Nevada told FOX5 Monday it will sue the Clark County School District.
“There is going to be a lawsuit filed against the district on behalf of this. At this point, we can only take so much disrespect towards the community, towards our news media, towards our clients, towards our organization,” said ACLU of Nevada Executive Director Athar Haseebullah.
This all stems from a February 2023 incident outside Durango High School. A CCSD officer is seen on cell phone video taking a student to the ground. CCSD never said why it stopped a group of students in the first place, but did say officers were in the area to investigate reports of a gun off campus.
No gun was ever found. One of the students involved said he wanted to record police on his cell phone when he was handcuffed. Another told FOX5 that an officer said he was jaywalking.
FOX5 filed requests to get written information, as well as body camera video, from officers that day. CCSD denied those requests. But the district was forced to turn over body camera video, and just this week released nearly 2,000 pages of internal emails after the ACLU sued for access and won.
The ACLU has said CCSD has not been transparent for months by not turning over information it believes is public. CCSD claimed some of the information was protected because of juveniles involved and because of an open and active investigation.
“All the district is doing is requiring that we file a lawsuit and depose everybody that was involved here. And if that’s the way they want to do things that’s what’s going to end up happening,” said Haseebullah.
CCSD did not get back to FOX5 on Friday when we asked for a response to the release of emails. CCSD did get back to us Monday about the lawsuit and said it does not comment on potential litigation.
