LAS VEGAS, Nev. (FOX5) – Huntridge Theater’s renovation may be on hold because of a cell tower, a lawsuit says.
Brass Monkey, LLC with Dapper Companies filed an emergency temporary restraining order and request for preliminary injunction against Crown Castle Inc. and AT&T.
The lawsuit says Crown Castle and AT&T are refusing to cooperate in the relocation of a cell tower located on the theater’s property. It has caused “significant delay” in the restoration of the theater.
Brass Monkey says the two companies breached the 1996 lease agreement by failing to comply with federal regulations governing cellular towers located at or near historic buildings.
“Records indicate neither AT&T, nor Crown Castle, obtained the necessary approvals from the Federal Communications Commission prior to, or during, the time the tower has been present on the Huntridge property,” the lawsuit alleges. “The Huntridge Theater was included on the National Register of Historic Places in 1993, predating the lease agreement by several years.”
Brass Monkey says they seek relief to relocate the tower and ensure redevelopment proceeds without further delay.
“We remain committed to the preservation and revitalization of the project,” said J. Dapper, principal of Brass Monkey, LLC and owner of the Huntridge Theater. “This legal action is necessary to prevent further harm to the property, in addition to putting us back on track with the renovation.”
