HENDERSON, Nev. (FOX5) – The owner of 39 dogs filed an “order for return of seized property” as five French Bulldogs are pregnant.
In June, the Henderson Police Department discovered the dogs while exercising a search warrant in the 2000 block of Lincoln Road.
Police arrested two men, Roberto Gonzalez-Fleites and Yankiel Gonzalez, on drug charges unrelated to the dogs.
FOX5 also obtained new photos from Clark County of the puppy mill the dogs were found in.
The owner claims that the order will be used to get the pregnant dogs to a third-party veterinarian to help them give birth.
The motion was discussed Wednesday morning.
Defense claims that one of the animals may be a service dog and that the search warrant in which they were found had nothing to do with the animals.
However, the state says animal control only needs to “observe cruelty” before seizing.
The judge said the defense must prove that there was no cruelty and that the dogs have adequate care and shelter before they can be returned.
The defense continued claiming that there was no cruelty and that the dogs were registered and vaccinated. However, if the county could provide evidence that contradicts this, they may get custody.
An evidentiary hearing is scheduled for Friday, July 12.
